1. Preliminary Provisions
The online store lastmsg.eu, available at the website https://lastmsg.eu, is operated by roothelp.pl - Maciej Kucharski, with its registered office in Ryki at ul. Żytnia 76, tax identification number (NIP) 5060023792, National Business Registry Number (REGON) 361089180.
This Terms and Conditions document defines the rules for using the online store and the terms and conditions for concluding distance sales agreements with Customers through the Store.
2. Definitions
Customer - a natural person with full legal capacity, a legal person, or an organizational unit without legal personality, placing Orders and making purchases of Services in the Store.
Seller - a natural person conducting business activity under the name roothelp.pl - Maciej Kucharski, with its registered office in Ryki at ul. Żytnia 76, postal code 08-500, registered in the National Court Register (KRS) under number [KRS Number], with a share capital of [Share Capital] PLN, tax identification number (NIP) 5060023792, National Business Registry Number (REGON) 361089180.
Store - an online store operated by the Seller at the website https://lastmsg.eu.
Distance Sales Agreement - an agreement concluded with the Customer within the organized system of concluding distance agreements (within the Store), without the simultaneous physical presence of the parties, exclusively using one or more means of distance communication until the conclusion of the agreement.
Terms and Conditions - these Store regulations.
Order - the Customer's declaration of intent made using the Order Form and directly aimed at concluding a Sales Agreement for a Service or Services with the Seller.
Account - a customer's account in the Store where the data provided by the Customer and information about Orders placed by the Customer in the Store are stored.
Order Form - an interactive form available in the Store that allows the placement of Orders, in particular, by adding Services to the Cart and specifying the terms of the Sales Agreement.
Cart - a Store software element where the selected Services for purchase are visible, and where it is possible to determine and modify the Order data, in particular, the quantity of services.
Service - a Service available in the Store that is the subject of a Sales Agreement between the Customer and the Seller.
Sales Agreement - a Sales Agreement for a Service concluded or to be concluded between the Customer and the Seller through the online Store. The Sales Agreement also means - concerning the characteristics of the Service - a contract for the provision of services.
Przelewy24 - PayPro S.A. company based in Poznań, entered into the National Court Register of Entrepreneurs kept by the District Court in Poznań - Nowe Miasto and Wilda in Poznań, VIII Economic Division of the National Court Register under the number KRS 0000347935.

The Customer can communicate with the Seller using the contact form.
4. Technical Requirements
To use the service and place orders for services, the following are required:
a. An end device with internet access and a web browser,
b. An active email account (email),
c. Enabled cookie support in the web browser.
5. Range of Services
The range of services offered by the Store includes enabling Customers to make purchases through the online platform.
Services purchased in the Store are, by default, considered lifetime purchases (not applicable to services sold in the form of subscriptions). However, in line with our commitment to customers, the Store undertakes to provide technical support and assistance in maintaining the service for a minimum period of 5 years from the date of purchase.
6. Placing an Order
To place an Order in the Store, the Customer should add services using the order form and use the "Proceed to Payment" button.
Placing an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement in accordance with these Terms and Conditions.
7. Prices and Payments
Prices for services displayed on the Store's pages are provided depending on the selected currency and are gross prices (including VAT). The price listed next to each service is binding at the time of placing the Order by the Customer.
The Customer has the option to choose one of the electronic payment methods available on the payment form provided by Przelewy24.
8. Order Fulfillment
The order fulfillment period is up to 7 business days and is counted from the moment the order is confirmed by the Seller, but in most cases, this will happen automatically after payment approval.
9. Right to Withdraw from the Agreement
The Customer who has concluded a Sales Agreement may withdraw from it within 14 days without giving any reason.
Withdrawal from the Sales Agreement by the Customer can be made by submitting a written statement via the contact form.
In the event of withdrawal from the Sales Agreement, the Agreement is considered not to have been concluded.
10. Complaints and Warranties
In the event of a defect in the Service, the Customer has the right to make a complaint under the provisions of the warranty in the Civil Code.
Complaints can be submitted to the Seller's address provided in § 3 of the Terms and Conditions or via the contact form.
The complaint will be considered by the Seller immediately, no later than within 14 days from the date of its submission. The response to the complaint is sent to the Customer's email address or in another way agreed with the Customer.
11. Privacy Policy
The Seller is the Administrator of Customers' personal data collected through the Store.
Customers provide personal data voluntarily.
Customers have the right to access the content of their personal data and to correct it.
12. Final Provisions
Matters not regulated in these Terms and Conditions are subject to the provisions of the Civil Code, the Act on the provision of electronic services, the Consumer Rights Act, and other relevant Polish law regulations.
The Seller reserves the right to change the Terms and Conditions at any time. All orders accepted for execution before the effective date of the Terms and Conditions amendments are executed based on the Terms and Conditions in force on the day of placing the Order by the Customer.
All disputes arising from the Sales Agreement or the Offer Agreement will be resolved by the competent common court.
